UPDATE: EDO ELECTION PETITION TRIBUNAL BETWEEN HON ABUBUBAKAR MOMOH AND SEN FRANCIS ALIMIKHENA

Yesterday was another interesting day as the second respondent (All Progressives Congress, APC) closed it case after calling 7 witnesses.

Recall that on the 3rd of August, the second respondent brought 3 witnesses and another 4 witnesses yesterday to make it a total of 7 before closing it case.

Meanwhile the 3rd respondent (INEC) closes its case without calling any witness.

The first witness was Prof. Moses Osawaru, a lecturer, who lives in the Senior Staff quarters, University of Benin.

He was the Returning Officer for the Edo North senatorial election

Under Cross Examination by Counsel to the petitioners (Momoh/PDP)

In exhibit P842, I put it to you that the alteration in the result sheet you signed was done In other to tally with other results and he answered not at all

As a returning officer, you were suppose to look at exhibit ECAC result submited to you by the LGA agent before entry them into ECAD. and he answered, I did.

It’s also correct that you saw all the ECAC before you completed the ECAD and he said yes.

In your statement, you stated that 4 LGA result were dated 24 of February, when was others dated and
he answered dated later in the night

Look at Paragraph 10 of your statement and tell the court the total number of accredited voters ECA4 you recorded. he answered 210,85

Will you be surprised that the total number of accredited voters in the entire local was 192,701?
He said he it could even be more than that.

The APC counsel called on witness number 73 to 73 on the witness list.

Asked if on the 3rd of April he came to sign his witness statement of oath and he said yes

Asked If he sees the statement on oath if he will be able to recognize it. He answered yes.

Do you you want to adopt it as your evidence in this honourable court? He said yes.

Counsel To 2nd respondent (Alimikhena)

Asked if It is correct that you acted as ward 4 collation agent in Etsako west and he said yes.

As the ward collation agent, you were also the supervisor in your ward and he said he monitored and supervised his entire ward

Asked if It is correct after he voted he went round to supervise other units – he replied yes

Asked if through out he went round, if he notice any inducement or attack by thugs… He answered nobody was molested nor money shared

Counsel To Third Respondent (INEC)

As the ward agent, do you confirm that you were in your ward during the election?
He said I was in my ward through out

Asked if there were security operatives across the voting points in the ward, he said yes.

Counsel To Petitioners (Momoh/PDP)

Asked if he was actually in the ward through out the election, he said yes.

You were also in that ward as senatorial collation agent he said yes.

Asked How many polling units in ward 4 in Etsako West, He answered, 10 polling units…

I will be correct to say that you were not in all the polling units on election that… He said he was because the units are close

I put it to you because you didn’t participated in the election of other units, you didn’t know if there was vote buying in other units he said there was no vote buying…

Counsel To 2nd Respondent (APC)

Abdullahi Ibrahim from Ugieda, south ibie Etsako West, A business man.

Asked if he came to sign his witness statement of oath on the 3rd of April, He said yes.

If you see the witness statement, can you be able to identify it, he replied with a yes

Do you wish to adopt it as your evidence in this court and he said yes.

Counsel To The 2nd Respondent (Alimekhena)

Asked to confirm if he voted on that day after accreditation , he answered, yes I voted.

Asked to also confirm if he was at his polling unit through out the election, he said yes.

It is also correct that throughout that day there’s was nothing like ballot box snatching, ballot papers remover and card readers remover and he answered nothing like that.

Also confirm that there were no thugs on election day, he answered yes.

Asked if after election, the ballot papers were sorted and counted before the announcement of results he said yes.

Counsel To Third Respondent (INEC)

Can you confirm that there were only police men as security operatives in your unit? He answered yes.

You also confirm that you were at your polling unit from the beginning to the end. He said yes.

You also confirm that INEC officials were at your polling unit from the beginning to the end. He said yes

Confirm that voting went on smoothly in your polling unit and he said yes.

Counsel To The Petitioners (Momoh/PDP)

I will be correct to say that you are not a member of APC and you were not the agent of your unit and he replied, I’m a member of APC and I was the agent.

I will be correct to also say that you don’t have anything to show that you were the agent of APC and he said I have everything to show.

Asked to show his agent tag to the court, he showed his agent tag.

I will be correct to say this unit you worked is in Akoko Edo not in Etsako West. He said no.

Read your paragraph 1 in your witness statement and he did.

This your deposition you signed, that you worked in Akoko Edo, did you stand by it? He said yes

Counsel To The 2nd Respondent (APC)

Friday Anavhelokha
From Ugbenor, Etsako West, A Business man.

On the 3rd day of April you came to this court to sign your witness statement of oath. He said yes

If you see the witness statement, will you be able to identify it? He answered yes

Asked if that was his signature, he said yes.

Asked if he wish to adopt it as his evidence before the tribunal and he said yes.

Counsel To The 1st Respondent (Alimikhena)

Asked to confirm if as the agent of his party, he was at his polling unit from the beginning to the end, he answered yes.

Confirm that on the day of election, there was no incident of votes buying and intimidation of voters – he said no there was no vote buying.

Counsel To The 3rd Respondent (INEC)

Asked if he was at his polling unit on the day of election – he said yes.

Also confirmed that there were security operatives at your polling unit, he said yes.

Counsel To The Petitioners (Momoh/PDP)

Confirm you only withnes what transpired in unit 8 and not other units, and he said yes.

I will be correct to say that not all the voters were captured with the smart card reader. He said all the voters

You signed the result from your unitl. He said yes

Show him exhibit p262 of Etsako West Ward 12 unit 8 is that the result you signed? Yes, but I signed in PDP column because PDP agent signed in my column.

Confirm That the explanation you just gave now is not contained in your witness deposition you adopted before the tribunal and he answered no.

The case was adjourned to the 27th of August for adoption of written addresses.
