Yesterday 3rd of August was very interesting as the first respondent (Senator Francis Alimikhena ) and the second respondent (APC) continued their defence.

Recall that the first respondent, haven brought three witnesses on the 31st of July and one more witness yesterday, the 3rd of August – making a total of four, before closing it case, while the second respondent (APC) started its defence today.

Counsel To 2nd Respondent (APC)

Tell this honourable court your name.
Monica Igbadumhe, she responded.

He asked about her occupation and she said she is a business woman

He asked where she lives, and she said she lives in Jattu

On the 3rd of April you came to sign your withness statement of oath and she said yes

Asked If she sees the witness statement of oath will she be able to identify it? And she answered in the affirmative.

Counsel shows her exhibit P50, Is that your unit result? She said yes.

Counsel To 1st Respondent (Alimkhena)

Asked if she was the agent in unit 4 ward 11 Etsako West LGA, and she answered with a Yes.

You also voted in your unit that day and she said yes

On the day of election, other people also voted in your unit? She answered with a yes.

Asked to confirm to this court that the election was very peaceful and free and fair and she said very free and fair

Asked if she was in her polling unit throughout on the day of election. She said yes.

On that day of election, there was no vote buying and intimidation by APC and she said no.

Lastly, is the result just shown to you, is a true reflection of what happened on election day? And she answered Yes

Counsel To 3rd Respondent (INEC)

As agent of the second respondent, I will be right to say you were in your poling unit throughout the election, Am I correct? she said Yes

You also confirm that there were adequate security in your polling unit – She answered yes

Also, confirm that you voted according to your conscience – she said yes

Shows her exhibit p58, can you tell the court the result – She said APC 422 PDP 165

Can you confirm that the result was signed by you and PDP agent… I signed the result and PDP agent did same.

You stated in paragraph 6 of your witness statement that the result in your polling unit were awarded, Do You still stand by your statement?

Yes – but I don’t really know the meaning of the word ‘awarded’.

I will be correct to say that you didn’t write the witness statement – and she said she wrote it.

Asked to show her exhibit 844 page 18 serial number 4, the ward 11 polling unit 4, for etsako west, Omogbai, TV road Yelwa Azama primary school

That total number of accredited in your unit is 372 according to exhibit 844..- and she said the accreditation record is contain in the result sheet she signed.

The accreditation in your unit result sheet you signed is 587 while the total number of accredited voters is 372

Where did you get the remaining 215 figure from? – she said the result she signed is the correct one and don’t know where the other result came from.

On the 3rd day of April you signed your witness statement on oath… He replied yes

Counsel To First Respondents (Alimikhena)

You stated in your paragraph 16 on your witnesses statement that you were the agent of APC in your polling unit- He said yes

Do you have any means of identification? He said Yes and presented his APC agent tag and voters card.

On election day you acted as APC Ward 1 unit 4, Auchi Etsako West. – he said yes

Asked if he voted after due accreditation – he replied yes

Asked to confirm if other voters also voted after they were accredited in his polling unit – and he said yes

Confirm to this court that on the day of election APC were having 2 agents.. He said yes and Momodu lawal was the second agent

Asked to Confirm if the election was peaceful and free and fair – he said yes

Asked if there was no vote buying by APC and others in his polling unit – he said yes.

I put it to you that one INEC staff Rasheed Yakubu is not a son of an APC chieftain – he said no.

Asked if he know that all voters in your unit voted once – he said yes.

Counsel To 3rd Respondent (INEC)

Asked if he Can confirm that he was at the Polling Unit on the day of election. He said Yes

Can you also confirm that there was adequate security on the day of election – he said yes

Can you confirm that were card reader didn’t work, they use manual accreditation – he said yes

You agree with me that the result you got from your unit was done with the the smart card reader and manually – he said yes

Asked if he witness any vote buying by PDP, APC on election day? He said no.

Asked if it is true that he didn’t sign his polling unit result as APC agent? He said yes, he was not the one that signed it

I put it to you that you haven’t seen your polling unit result before – he said yes that he haven’t see the result before now.

Asked if everybody that voted on election day didn’t pass through the card reader accreditation. He said Yes

I Will be correct to say that the card reader come first during the process of voting – he said yes.

It is correct that the accredited number of people that voted on election day didn’t pass through smart card reader on that day.. He said No.

That means they voted using smart card reader – and he said yes.

If you see the name of your Polling Unit anywhere can you recognize it – he said yes

Asked to Confirm on the 3rd day of April you came to sign your witness statement in this court- he said yes

Asked to confirm if he stated in paragraph 3 of his witness statement that he was the agent of APC and he said yes.

Confirm you acted as an agent for the second respondent and he said yes

You voted on election after your accreditation? He replied with yes

Asked if others also voted like him in his polling unit – he said yes

Asked to also confirm that after the election, he signed the result sheet on election day and PDP agent one Akhigbe ojeagbase also signed… He said Yes

Asked if after election the agent of the PDP congratulated him – he said Yes.

Can you confirm that there was no
vote buying on election day by any body , he said yes.

Also confirm that only one person was allowed to vote secretly on that day – he said yes

In paragraph 5 of your witness statement, you stated that the total number of votes cast is equal to the total number of accredited voters, is that correct?- he replied yes

Asked As an agent if he was in his unit from the beginning to the end of the election – and he said yes

Asked if there were security operatives in the polling unit on that day – he said yes

You also confirmed that were the card reader was not use for accreditation purpose, the INEC officer use voter register for manual accreditation .. He said Yes

The total number of accredited voters was derived by what was done with the Smart card reader and manually – he said yes

Asked to Look at exhibit P609, do you confirm that on the top right corner there was alteration, he said yes.

Do you also confirm that the alteration was done by INEC officials he also said yes.

Confirmed you observe how the election was don… He said he confirmed

Asked if it is correct that every voter will insert PVC into the smart card reader before accreditation. He said Yes

Is it also correct that anyone who didn’t pass through the card reader can not vote – he said not correct

Asked How many people did their PVC didn’t pass through card reader in his unit, – he said he didn’t know anything about that.

Is it correct that everybody who voted in your unit on election day, Their PVC pass through the card reader… He said he didn’t know about it.

I put it to you that you didn’t observe What happened on election day – he said he observed everything as an agent.

Counsel To 1st Respondent (ALIMEKHENA)

confirmed that you acted as ward collation officer in ward 8 Owan West of Edo state and he said yes

Confirm you voted after accreditation – he said yes

Asked if the election was peaceful and free and fair – He said yes.

On that day your duty was to supervise all other agents under your ward. He said yes

Also confirm if all other units are in same place- he said yes

At the end of election, you collected all duplicated copies from all the ward polling unit agents, he said yes

I put it to you that on that day, there was no over voting in unit 12, 13, 14 and he said yes

Asked if on the day of election, the total number of votes case were all lawful – he said yes

Counsel To 3rd Respondent (INEC)

Confirm that all the units in your ward are in the same place – he said yes

Were you the only ward collation agent of your party? He said I was the only agent

Can you confirm that you signed the election result from your ward and PDP agent did same he said he signed the result but PDP agent did not sign

Was there security agents on ground – he said yes

Did you agree with me that the card readers and voters register were used for accreditation on that day- He said no because the card readers were not functioning.

The judge asked again are you saying that the card readers did not work in the entire units in your ward? He said Yes

Asked if the results contain in exhibit pa0 is what transpired in his ward – he said yes
